Help from Justice System People

SITUATION

A real estate agent, being  a lawyer, skillfully used my good intentions and unfamiliarity with local specifics, inspired me to buy a house with a land, which seemed was good for my purpose. It came out to be a total scam- a house not fitted for living (dampness), garage being illegal and big part of land got expropriated by the government. I became kind of homeless and dealt with Justice System.
 Local lawyer, I hired with purpose of mediation and finding a compromise, didn’t care about my interests as opposite party were her friends. Her only goal was to get me to court process. Of course I refused.

Not local lawyers would be very expensive and process would go for years
American embassy refused to get involved, giving me their list of lawyers. I applied to one of them, saying that go to court is not a solution for me as processes here go for years. Local lawyers would not care of my interest and lawyers from the capital are very expensive. Going to court against local lawyer and notary with many important connections is a crazy solution.

The lawyer from the list said with help of American embassy through the lawyer things work differently and faster. This sounded good. After seeing my documents he said Embassy is not my case. I did asked him what he found different in the documents compare to my description of the case. He did not have an answer, so I understood that Embassy got involved, if it’s huge money, as mafia or something like that, cases of serious corruption and I do not fit in that category

The lawer stated his position
- LAWYER: The only way to undo the contract is by denouncing in the police station and pursue criminal charges. Unfortunately we can not do that from Tirana. And the associated costs  are considerate.  Hence i recommended a lawyer from Vlora, where the costs would be substantially lower

In the office of prosecutor however I was said that only civil process can undo the contract, the criminal case only punish scammers.
Also I was in capital city myself, trying to find help through different organizations. They all sent me back to my city. I tried to explain them why I came to capital, that I did everything in my city and found no help, but people just unable to hear and repeat the same “Solve your problem, where it occurred”

Once a local lawyer gave me the idea, that she could write a report to American Embassy and local Prosecutor. I loved the idea, I sent her the documents, then she started usual “playing with money issue ” instead of clearly naming the price. So, it didn’t work with her, but Idea stacked in my mind. Especially that it was one of my working tools- sending the same thing to different people in one paper. Often it works. So, I asked Tirana lawyer to do that

LAWYER: Okay i will. One clarification: are you asking a Letter, addressing these institutions or a Report? Bear in mind the report would be intended only for you as its sole recipient. Without pursuing proper legal actions with a lawyer, you are not really close to solving it! The letter can have either this effect or simply he dismisses it. - We as an office sympathies with your case, and were willing to do the letter pro bono (for FREE), further actions will need proper representation. Please tell us how to proceed

I got Hope (again!!!) and started to wait. In 10 days I decided to remind him and the same day he sent it. But it was not a  promised Letter. I got what he called as “report” for me as a sole recipient with punishment for disclosure the content, offering to make indictment (report of criminality to start criminal case) for $200 and offer to represent my case.

People here not only neglect to keep their words about agreed time or place, but also do not do what was agreed to do. WOW! But my first Vlora lawyer also did that. Why I’m again surprised?
First I thought he wanted $200 for the letter to institutions I wanted.  I started to clarify the Letter, but Lawyer found it tiring and irritating. He started to confuse me more. I do understand, people need to make money, but it’s not my fault, that people do NOT hear words that retired person, who have nobody in the country and without language cannot afford expensive court case.

With Letter I asked I hoped the prosecutor will initiate a case, giving pro bono lawyer and translator. I hoped he would consider that case went to American Embassy, I hoped that he would consider that I have American mentality and not submissive local one
And overall  WHY promised one thing, making person to wait and hope and instead doing something different , which is profitable for the lawyer.
And call it “We as an office sympathize with your case”? Strange sympathy, however

ME: We talked about sending a letter to Prosecutor , Police and USA Embassy and copy to me.    (I still hoped to get what I waited for so long with a hope  with $200 payment for that )

Lawyer however went his way: -You make your own decisions. Thank you for having reached us and we hope the answer has been exhaustive! We do not take cases beyond Tirana

What the point to point that I am the one , making decision, when  others carry my decision in real life and do it the way, which is profitable for them. And their way is not permanent, but pretty much as one Albanian person said ‘zig-zag “way. "We do not take cases", while 10 minutes ago he wanted to count all the expenses, applying to my case

Me however straight and permanent –“I just need the same letter address to a few places- That what we discussed before”

Lawyer: Even if we prepare the indictment on your behalf, you will be called into Court, and then you will have to take your own lawyer to represent you. That is the letter simplified
Me: Not the letter we talked about.  I am homeless Pensioner. I cannot pay for criminality of local people. But in letter I will inform  about that a few places.
Lawyer: There is no other letter addressing the authorities except through a formal "suing"
Before he wrote, that prosecutor could take an actions or dismiss the letter, so no any JUSTICE without money. Out of sympathy I received only frustration

Me:What would be in a Letter?

Lawyer: Miss, i find this conversation very tiring! And is wholly unbeneficial! We do not take cases outside Tirana , except in a rarity. So get in touch with some Vlora lawyer and have the issue resolved there, they can prepare a kallezim penal (criminal indictments) and represent you in court

ME: I’m tired too. Because you do not want to make it clear for me.....I just ask a LETTER not the case

-Good day mam! Take care. -You do not like the Truth. Sorry.

And my Emotions started to pour- Trusting official people as lawyer and notary is NOT a criminal. Making FAKE documents, using Fake specialist IS criminal, selling defected house is  criminal activity. Nobody cares - Not government, not Justice System...unfortunately. That is a TRUTH....and nobody likes to hear that Truth....I understand that.....; I wish you luck!!!! You need to live and survive-I understand that
He gave me the link with pro bono lawyers, but then he deleted it ….and I started again, pointing to fake promises, copying our previous conversation

With that Letter I hoped to get pro bono or on contingency basis lawyer and also               
 WHY promised one thing, make person to wait and hope and NOT do it.  Is that what is called “We as an office sympathize with your case”? “

HIS WAY vs MY WAY
               
I wrote to him what was said and what was done with his actual words from our conversation. Explaining that with the promised Letter I hoped they would start a case themselves and give me a free lawyer and translator (as I was explained in the prosecutor office by some worker). Also criminal case would not return me money for the house (3 different places gave that info), but punish criminal activities, so at least the justice would be served. Justice for me is more important than money . For that I asked about the Letter and was willing to pay for that. for letter, not for the case in court

Lawyer used that his way: It's not about waiting; rather pursuing a cause of action must suitable to your circumstances. But then again the problem is yours, we tried our best to guide you in the process. The problem is and we figured it rather late is that you don't need guidance, you want free representation in court and we do not offer pro bono services! There are other lawyers who do, so please get in reach with them! All the best!

A person hears ONLY what he could use for own benefits
And he gave me again a site of lawyers, what he deleted before. Paying for lawyer against criminality of local specialists did not make any sense.
 But it’s a difference-If I ask for pro bono lawyer myself, I’d not get it, consider my income. Different story if Prosecutor pursues a case and appoint lawyer to me. But the lawyer was not able to hear that and kept playing his games, making it as misunderstanding and trying to make me as an ungrateful person

Me-You promised a LETTER, not a guidance. I asked for a Letter

Tirana Lawyer - I've told a thousand times, by letter i meant a legal denunciation! That is a formal letter that requires  some legal knowledge. Not letter in the ordinary sense of the word. A criminal indictment. -Other forms of letters, you are more than capable of writing yourself, they don't require legal knowledge! But they are totally useless as a general course of action! You want to undue a contract! You do so that by going to court

As usual in such situation when people lie and defend their lying I go into moralizing speeches

But then again do get in reach with other lawyers, address your issue and see what kind of solutions they bring in the table and take informed based decisions! The lawyer called me on the phone and was pretty rude. During the conversation I asked for his name, so I could address to him by name, but he refused to name it
I’m a person who always honestly pays for the job, but I like first to discuss the job, make My choice and pay, when the discussed job is done. It seems so simple

-Concerns they show in public. In private they politely wrote their sorry and indicated that for them Americans and Albanians are equal and they only gave me a list of private lawyers. If you have an idea how to get JUSTICE without Justice System it'd great because I was robbed by a lawyer-real estate agent the very nasty way and people mostly on his side and that adds to my feelings of injustice here

COMMENT on NOT listening a person, whom wanting to help

I wrote that I was in police and other places-he recommend to go there. He agreed that Justice System does not work-he recommend me to use it. When people say things they don't follow their own words. When I point to that-they because angry. I have big problem communicating with people as in my mind I keep a train of conversation, but they seems do not. Usually it bring conflict
Both people should be flexible in conversation and react to what was being said right now

- I was sold damaged house, garage without documents and land which government takes for road reconstruction. They started last year, cut one side and left without finishing. The nastiest thing is that the agent used my intentions to work there with autistic kids, so in fact he stole money from them, more than from me.  Legal way to get justice does not exist. I don't want revenge. I want my money back, but I cannot pay lawyer and wait for years and years for result, Police sent me to prosecutor and prosecutor sent me back to police

- Lawyers is NOT a solution that is why people do criminal things, because they know they are safe in the System It is called “Welcome  to Albania”

I should wait, but I decided to help him to help me giving him more information. It was mistake, but I could not know that. But with other people I try to wait, if they indicated to wait and did nothing, but waiting...Well, nothing good came out of waiting. Also when people say "wait", they do not say how long should I wait and its also...

- He was working for Russian real estate. Being Russian I figured out the boss, but AD was able to brainwashed me. When I already confronted him, he wanted to expel me out of Albania in 24 hours. Its not good situation here.  I'm not going to do illegal things, but Mayor knows, police knows, prosecutor knows and everybody knows and there is No any solution for the second year

- I do not live in USA any more I left that country. I lived in NYC

- to better understand . Are you telling me that you will live in Albania, and you will never go back to New York ?!

- I'm not sure about living in Albania, but I'd not go back to NYC. Although it sounded strange, but it happened that I developed some nice harmless System to work with autistic kids. I could not do it in USA for some reasons and for similar reasons I could not continue working. So I retired and moved to Macedonia as they promised I'd have an opportunity to work. Anyway here I hoped to invite Russian-speaking tourists with special kids and be independent from anybody and do my things.....but then A.D. did what he did.....that is the whole story....not good at all

Saying those things was really stupid as people would not be able to understand, Usually people do not clarify strange unclear situations, they just do their own assumptions and continue with them

And Jurist disappeared. I contacted him out of curiosity. I always try to make an end of any situation for my own mentality

- There is something wrong with what you tell me. I believe that if an Albanian had committed a crime or a contravention against you, he would not go out without being punished. If it is a matter of a civil nature, the only regular thing to do is to go to the Court. I don't know another way to go

COMMENT on different ways to conversations

He is on the moment, forgetting what we previously discussed about the System, but I keep the whole conversation in mind in details. It's a big problem. Knowing it I changed myself from previously emotional screaming person to very patient one, explaining the same over and over

- I know that. It’s a big money and years of process.  Also it’s a process against local people with contacts-a lawyer and notary-That is not a solution in my situation. I already tried to hire a lawyer here, but she was against my interest, as the opposite party was her friend. It’s a small city and everybody knows each other. Previously I asked different people to help me just being on my site, doing nothing, but showing that I was alone. Nobody agreed. People I knew did not want to do that. I could not ask that person and waiting for him to suggest something

It was time to stop that communication. Recently a real estate agent (and a lawyer) "willing to help" told me that other ways exist to "get justice" in my case, but smartly put it "on his friend, who would answer Friday, then Monday, Tuesday..", meanwhile he tried to rent me apartment. When I refused from apartment, he and "his knowledgeable wanting to help friend" disappeared. I KNOW there are other ways exist, but so far NOBODY helped me with that information.
 I think this particular Jurist being on that particular side lost his interests to Russian  person who changed God Blessed America for Albania and not for a purpose of business...I always try to part peacefully, but it never works.
Jurist did not want to part peacefully or by MY decision. His word should be the last one. Its also happened often as people think that the last word should the right word

-Lady, if I were you I would have gone to court without wasting time. If you want, let me introduce you to a reliable lawyer friend of mine, who is honest. Otherwise I don't know how I can help you in another way.

-In a criminal police also they said : "You found money for the house, you can find it for lawyer" I thought the government should care about crimes, not me. I was wrong. Revenge and Justice are different things. That money was intended for non-healthy children. They were stolen by healthy adults

-  Napoleon Bonaparti said; you can never start a war that you cannot win. If you have no money for the lawyer, forget it. Do you care that they stole money that was not yours but of people not in good health. Life is full of injustice both here and in any country of the world.

- It was MY money. I worked hard for many years to accumulate that money and wanted to spend them to help non-healthy kids. I do not want to feed lawyers who do not care about Justice. I have enough of injustice trusting the lawyer, who stole the money knowing what they were for. It is a disguising story

- You can't live the rest of your life thinking about this. You must go on. In life you win but also lose some battles. Life is a war that ends when you go to Heaven or Hell

On some point people start to teach me how I should live my life. In my turn I start to do the same-mostly moralizing

- You know in Soviet Union if a person got into trouble and especially disguising like that, people try to help you find solutions, even trying to punish dishonest person, giving him a lesson. And not giving lectures with beautiful words. I won many battles against injustice and will continue to try to do it. But everybody has own way to look at things. No problem!

- Here we are in Albania and not in Russia. Russia has remained a country where human rights are easily trampled on. You Russians have a Nasist dictator named Putin at the head of Russia, who imprisons and mistreats the opposition. Albania is in Europe and not in Russia. I'm sorry that your mind thinks like Russians and not Americans, since you also have an American passport. In the United States of America and Albania they don't use the harsh manners of the road, but they go to court. I wish you the best of luck, anyway!

He wants his word about soft manners to be the last

- O ! Here we are! Americans and Albanians have great manners! To steal money is OK with soft manners and charm smiles.  Now go feed some lawyers in corrupted system. YOU offered HELP-ask for details and then give me hypocritical lectures how to live my life... Do not worry about my mind. Take care of yours. For me ANY person is equal, if he is Honest and Decent. Take care of your totally confused mind ...Sorry for you! ...

TRUTH for TRUTH

- I don't care about you at all. I have my life and I enjoy it the way I want. You wanted advice and I told you what I think. I don't know you and I don't owe you any favors. You are completely anonymous to me. You didn't like it and I don't care. If you were satisfied and expected me to threaten for you, a corrupt lawyer or thief you were wrong. Get someone else to do dirty work for you, or pay a bodyguard... And maybe you came to my country to spy on the Russians, otherwise the US embassy would not have left you to your fate.

- Sure, go to American embassy and tell them that a big terrible spy got to Albania. Why you are so aggressive? What is wrong with you? I just wanted to have a wise advice of a person from the field, because you offered help. If you'd have an autistic child and asked me for advice on something as I work in that field, sure I'd give it to you. I'd not say "Go find a professional"-everybody knows that. Something is wrong with your thinking-too aggressive, putting dirty ideas on other people. For me no problem as I was working with all kind of emotional issues. And also try not to put on regular people your political perspective...Don't stereotype people. Those are good things I'm telling you. You represent Justice System- Justice should not be bought (your words) or use the dirty tricks ... Justice just should be !

-  Honorable Russian-American lady. I gave my opinion, how you could solve your problem. Tell me how this problem is solved in Russia, which is not correct on your part. You tell me I have no money to pay for corrupt lawyers. But what are you expecting?! Do I have to pay your lawyer for you to be satisfied?! Maybe you are desperate, but it is not my fault and you must not offend me as I am in my country and highly respected by everyone in this city. I do not represent the judicial system in Albania. I am not a prosecutor, nor do a judge and I not carry out the profession of lawyer. I am an employee of the Albanian state and I try to do my job respecting the laws of my country. We all know that justice in Albania has problems, but I am neither the cause nor the magical solution. I am a man, not the God!

-I told you what I expected. If person offer a help, the attitude is very strange.  "To hire a lawyer" does not solve my problem. Regular people told me that long time ago, Tirana lawyer told me what is the situation now in Justice System....You also supported that opinion in the beginning. After learning my origin you changed your attitude. I'm a legal resident of that country. I spent here Honest money earned by hard work and paid all the taxes and planned to spend them for Albanian non-healthy kids.

By the way when the fraud became obvious the lawyer threatened to expel me out of the country on 24/7...I'm really very surprised by such attitude to foreign person. And so passionately defending a person, who committed a crime. But it’s OK, do not worry. I want nothing from you, just tried to understand the logic behind your attitude….

There is organizations exist in your country which help people in trouble and without money, there are TV shows and so on. People give me different advices.  Nothing is wrong with that

I did find things I could do without paying lawyers. For me things are clear. He offered help. Disappeared after I said about Russian origin, insisting on hiring a lawyer and putting on me all kinds of suspicions and dirty ideas, when I refused to hire a lawyer even his honest friend. Even to the point of being American or Russian spy. At least with him we could discuss What would be Justice for Me in given Situation. I never have that discussion with anybody for 2 years

I check American Embassy to the end, asking just to have a simple talk and they refused. they gave me Albanian employee to talk, a nice man. But we discussed his own issues which he could not solve by years and overall situation in Albania. He was sincerely surprised and somewhat upset, that Americans refused to get involved. I wrote to them that my life is in danger as I'm trying to get some justice in my Situation and local people do not like that and asked for some support. Clearly they reply to go to local services

CHOICE or a WAY

Did I try things to avoid fight and confrontation? Sure I did "Please, give me the money for MY land government took and together with pension I saved I'll buy a place to life as a Solution for my Situation
They refused, making me to fight for Justice with new stronger energy

Fighting for justice is NOT my choice, but My Way
Accepting it brings a lot of inner peace
