WHY THE WORLD IS CRACKING AND WHAT CANADA SHOULD DO. A Short Treaty.

I will not burden you with quotes and academic footnotes. This is a publicistic work, but it has deep historical, political and legal roots. My long life, study and practical work in the USSR and North America is the result of its writing.

INTRODUCTION: DID HISTORIANS INVENT THE MONGOL EMPIRE?

The Mongols called themselves Yeke Mongol Ulus - The Great Mongol State / People. In Guyuk Khan's letter to Pope Innocent IV in 1246 the seal reads: Dalai-yin Haganu jarlig - Decree of the Oceanic Khagan. Latin contemporaries translated it as Imperium Mongalorum because they had no other word for a huge, multi-ethnic polity where one center collects tribute and appoints rulers.

But can we call Rome and the camp of Genghis Khan by the same word?

Modern history says an empire has 4 criteria: 1. Huge, multicultural territory gathered by conquest. 2. One sovereign center that holds periphery by idea of legitimacy. 3. Hierarchy of peoples. 4. Universal claim - "we rule the world".

Yeke Mongol Ulus 1206-1260 fits all four. But there are two completely different types of empires.

A sedentary, European type: Rome, Byzantium. Basis - territory, law, bureaucracy, cities, census. Ethics - universal law for all.

A nomadic, steppe empire: Xiongnu, Turkic Khaganate, Mongols. Basis - not land, but people and roads. State is a network of personal oaths, kinship and distribution of pastures. Ethics - not law, but Yasa and custom of ancestors and charisma of the Golden Kin. This is what Gumilev called a "nomadic super-ethnos", what Thomas Barfield called a "shadow empire" - it cannot exist without sedentary neighbors whom it taxes but does not directly rule.

When we call both types by one word "empire", we lose this difference. And this creates deep political mistakes.

And here is where modern China comes in with One Belt - One Road. Chinese historiography says: Genghis Khan is Yuan, and Yuan is a Chinese dynasty. So Mongol conquest is an internal affair of China. Then the whole network of roads guarded by Mongols from Crimea to Hangzhou was a prototype of Chinese globalization. And "One Belt - One Road" is not expansion, but restoration of a natural, non-European, Eurasian exchange system, where the center is not Rome / Washington / Brussels, but Zhongguo - the Middle State. Tribute is replaced by investments, yam service - by logistic hubs.

PART 1. THREE DIFFERENT WORLDS OF PROPERTY

Rule 1. Roman. European. Dominium.
Land is mine. Private. Sacred. I bought it, I am owner. State is a contract of owners to protect my land. This is Europe, classic USA. Its power is norm, law, court. Misreading: China and Russia read it as 19th-century colonialism. But it is no longer about territory. It is about standard. It does not need your land, it needs its arbitration court, its CO2 norms, its GDPR on your land. Its blind spot: it sincerely does not understand that its universal norm looks to others like a local, European norm.

Rule 2. Horde. Khan's. Yasa of Genghis Khan.
All land is Khan's. All. No private land. There is only yarlik - permission of Khan to use land for service. You serve - you hold land. Stop serving - yarlik revoked. State is not a contract, but a network of roads and yams - post stations - where Khan collects tribute and distributes yarliks. This is Mongol Empire, Muscovite Tsardom, USSR, modern China and - attention - modern Canada, where all land is Crown Land.

What is Yasa? The authentic text of Ikh Zasag did not survive. We know it from Juvayni, Rashid al-Din. There is no section "On Property". And that is the point. In steppe ethics land ownership does not exist. Land, water, sky belong to Eternal Blue Sky - Tengri. Khan does not give land. He gives people living on it and income from them. Formula: "I grant you such-and-such people". Property is conditional holding for loyalty. You can be different inside, with different faith. Main thing - recognize seniority of Center and do not block the flow.

The West reads it as USSR 2.0 or USA 2.0: "China wants to become new hegemon". China does not want to impose a model. Its classic formula - zun wang rang yi - "revere the prince and drive away barbarians". That is, recognize ritual seniority and ensure order on your section of Silk Road.

Rule 3. Buffer. Russian.
When you live between first two. You cannot be Rome nor Horde. Your task - survive by holding width. You create belt of borderlands - ukrainas. You pay tribute to strong, but always ready to betray for survival. This is Russia, Iran, Turkey. What Russian princes received was not Yasa, but Yarlik. Yasa is on basis of which yarlik was issued.

What is Yarlik for princedom? In 1243 Batu summoned all surviving Russian princes to Sarai. He acted strictly by Yasa: all lands and people are now Ulus of Jochi, his property granted by Genghis. Prince is not owner of his principality by birthright, as in Russkaya Pravda. He must get confirmation of right to use.

Document was called yarlik - from Turkic yarliq - order, charter. Prince received: a) Yarlik for Grand Princedom of Vladimir - main, right to be senior among princes and collect tribute for Horde. b) Yarlik for his own patrimonial principality. c) Paiza - golden or silver tablet with inscription "By Power of Eternal Heaven, name of Khan be holy. Who does not obey - will die".

Procedure: Prince came to Sarai with gifts, passed purification rites between two fires - loyalty check to Heaven. Bowed, recognizing all power and land comes from Genghis kin. Genealogy checked. If yes - khan's scribe-bakhshi wrote yarlik with khan's tamga - red seal.

Key ethical inversion: By Russkaya Pravda and Roman tradition prince is owner of his votchina by birthright from Rurik. This is his dominium. By Yasa his votchina is not his. It is part of Ulus of Jochi, which Khan mercifully gives him in holding - in kormlenie - while he regularly pays exit and supplies warriors. Wants Khan - takes away and gives to another brother, as happened with Andrey Yaroslavich, from whom Alexander Nevsky took yarlik in 1252.

Hence chronicles write: "went to Horde to ask for princedom". To ask, not inherit. This is ethical revolution. Russian princes for 250 years accepted steppe norm: land not yours, power not from God and people, but from alien kin by mercy. And property right conditional.

This is where Moscow political formula was born: Grand Prince - sole holder of all land, all others - only his service holders by his mercy. This is not Russkaya Pravda, but not yet Roman law. This is Yasa transplanted onto sedentary soil.

Important: No original Golden Horde yarlik for Russian church in Mongolian, in Uyghur script, with red tamga - al tamga - survived. Not one. What we call "Yarlik of Uzbek 1313" is Russian translation of 14th century, copied in 16th, copied in 17th and published in 19th. But what we really have? Whole collection of church yarliks - 7 pieces: Mengu-Timur 1267, Tulyak 1378, Taidula 1347 and 1351, Berdibek 1357 etc., including Uzbek - came in one collection "Collection of yarliks of Tatar sovereigns given to Russian metropolitans". Stored in archive of Moscow metropolia. Oldest list where Uzbek yarlik exists is around 1510-1520. Between 1313 and list - 200 years of copying. Originals on Mongolian were, they were seen. In 1670s they were still held in Ambassadorial Prikaz, described: "Tatar charter on cotton paper, golden seal". Then - lost.

Yarlik of Uzbek 1313 to Metropolitan Peter - most scandalous. Uzbek - first Muslim khan of Golden Horde. He just made Islamic revolution, cut shamanist Genghisids. And suddenly gives yarlik to Christian church?

Long time historians, especially I. Berezin, considered it late forgery of metropolia. But Soviet turkologist A.P. Grigoriev proved authenticity by formulary. Russian monks could not forge it, because they did not know Mongolian chancellery formula.

Compare: Mengu-Timur 1267 - pagan: "By power of Highest God, by will of Highest Trinity, Mengu-Timur's word" Uzbek 1313 - Muslim: "By power of Highest and immortal God and greatness, Uzbek's word" Trinity removed! Only one "Highest God" - neutral for Muslim and Christian. This is Islamized formula Allah-Taala. And main - in Uzbek yarlik first appears direct reference, which was not in Mengu-Timur: "... not to deviate from previous yarliks given by previous tsars, according to their law of Genghis... And who deviates from Genghis Yasa..." That is Uzbek-Muslim says: I, though Muslim, confirm old Yasa of Genghis. Because Yasa is above Sharia in question of ruling ulus.

Russian copyist in 1510 would never write like that. He would write "by Orthodox law" or "by Tatar law". But here precise legal term - Genghis Yasa.

So yes - this is list from list from list, but list from authentic document. We lost paper and golden seal, but preserved legal logic. And this logic in Uzbek yarlik is even harsher than Mengu-Timur. There already directly: "And who takes something from priests and monks, then... that one to be executed by death". Under Mengu-Timur was "not needed". Under Uzbek already - death penalty. Because now church is under protection not just of khan, but of eternal law of Genghis.

PART 2. WHAT IS HAPPENING NOW

Kissinger and Mackinder are geniuses, but both prisoners of same Roman optics. They describe world where world is chessboard of sovereign territories fighting for control. World we just разобрали by yarliks does not fit into this board.

Mackinder with his Heartland - who controls Heartland controls World Island - is purest Horde logic translated into English. He looks at Eurasia with eyes of Batu: steppe is axis, key. He was right in 1904 when empires measured kilometers. But his mistake today: he thinks Heartland must be occupied. Chinese model shows Heartland must not be occupied. It must be stitched by roads, cables and credits. Not put garrison, but make your container go through it. Mackinder looked where to put fortress. Beijing looks where to put logistic hub. This is Yasa vs Roman Limes.

Kissinger - even more interesting. All his Westphalian system, balance of power, legitimacy - attempt to graft European experience of 1648 onto world, when after Thirty Years War everyone got tired of cutting each other for faith and agreed: each sovereign has own faith and sovereignty inside borders, and outside - balance.

Kissinger brilliantly applied it to USA and USSR. But model breaks on China. Because in Chinese worldview there was never Westphalia. No equal sovereigns. There was Center and periphery, ritual of kowtow - recognition of seniority, not equality.

Hence drama of modern experts. They take Mackinder map and Kissinger textbook and try to put "One Belt - One Road" on it. And they get "China builds military bases". And it builds yam stations.

Today three Centers fight, each with its own board.

USA under Trump: Classic USA after 1945 - top of Roman model: we bring universal norm, WTO, human rights, and for that we have right to judge. Trump 2.0 - revolt inside same model. USA tired of being Rome teaching everyone. Trump translated USA to Horde logic, but American style: no eternal allies, there are eternal deals. Each must pay for yarlik for security. This is family business logic, clan. Understandable both in Sarai and New York.

China under Xi: Xi is not Mao nor Deng. Mao gathered ideology, Deng - factories. Xi gathers network of Yasa itself in modern form. Belt and Road, own payment systems, satellites. He does not want to conquer you. He wants all flows - goods, money, data - go through his hub. And says: we do not care what norm you have inside, main - be loyal to network.

Europe of Ursula von der Leyen: Most pure carrier of Roman model. Its power is not army, but standard. Want to sell here - comply with our CO2 norms, GDPR, human rights. It has neither Horde network of China, nor American wallet of Trump. It has only stamp "complies". It tries to become world regulator - who writes rules for India and Brazil. But nobody wants to protect it.

Therefore there will be no peace in Ukraine. For Europe Russian flag over capital in Berlin, Rome or Paris is end of its world of norms. And for Russia flag over capital is proof that it is still Center that can put final point, as in 1945. This is dispute of symbols, not money. Symbols are not solved by deals. And in this sense Ukraine is not goal for Europe nor for Russia. It is instrument in dispute who will be regulator for those we decided to leave out - for India and Latin America.

G20 in December 2026, Trump, Xi and Putin will talk not about Ukraine. G20 is not Yalta and not UN. It is not place where borders divided. It is place where flows divided when borders cannot be divided.

For Trump Ukraine is asset in big deal with China: you don't touch Taiwan and help me with debt, I don't pressure you with tariffs to end. For Xi Ukraine is bargaining chip to show Europe: look, without us USA and Russia won't agree, so you need third arbiter - us. Trump and Putin will talk about Arctic and price of resources. This is where their logics coincide - family-clan and buffer. Both benefit from expensive but predictable market of oil, gas, uranium, and division of Arctic as closed club where Europe-regulator not allowed.

PART 3. WHAT IS CANADA AND WHY IT CRACKS

Canada is international dormitory built by Rule 2 but trying to live by Rule 1.

Legally Canada is not a republic. By British North America Act 1867 source of power is Crown. State is Crown. And Crown is legal entity, corporation sole. Eternal legal entity that never dies. King died - long live King, corporation continues. People is not sovereign. Sovereign is Crown. All land is Crown Land. They do not sell you land. They sell you right of use - estate. Allodial title remains with Crown. You are holder of yarlik, not owner.

While Crown was strong and could distribute land to immigrants, system worked. Came - got 100 acres - became Canadian. Homestead lived.

Now system broke in three places:

Landless appeared. Immigrant comes to Vancouver or Toronto, and there is no land. House - million. He does not become owner, he becomes eternal tenant of fund or bank. Man without land is in Roman law proletarius, landless. He has nothing to protect except benefits and access to system. So ready to stand under any strong flag promising protection here and now. We see it on island - when man cannot buy even trailer, he stops being Canadian in old sense.
Indians woke up. 150 years told: your land is now Crown Land, we give you reserve. Now courts say: no, it was never Crown Land, it is Aboriginal Title. And Indian looks at all - white farmer and new immigrant - as colonizers brought by Crown without his consent.
European Canadian small communities want both America and socialism. Old immigrant from Europe wants to live like in big America - with house and freedom, but wants Canadian "Horde socialism" - free medicine and protection from tsar-father. He does not want to renounce tsar because afraid to stay alone.
Result: homesteads you see on island die because holding yarlik from Crown became more expensive than it brings. Dormitory ordered to live long, because glue - contract - became too expensive, and there is no common core.

Canada today is Daniil Galitsky. Prince in steppe who went to Pope in Rome for crown to save from Horde, and Pope gave him charter but did not give army. So Canada goes to Europe for norms, but Europe will not give it army to protect those norms.

PART 4. WHAT TO DO. RECIPE FOR 10 YEARS

You cannot save Canada as dormitory. You can save it only as Union of Homestead Communities. Like Swiss Confederation.

Step 1. Return land to communities. For next 10 years transfer 30% of Crown Land from hands of Crown into hands of Community Land Trusts. Not sell to speculator, but transfer to community: farming, indigenous, urban cooperative. Man gets right to build and live forever, but not right to speculate land. This gives landless root, and Indian - recognition that land is communal, not tsar's.

Step 2. Recognize that Canada is not one nation, but contract of 5 peoples. Ottawa for 40 years says: we are all Canadians. In fact - 200 communities that do not see each other. Must officially recognize: Canada is not nation-state, but contract of 4-5 big civilizations on one territory: Anglo-Canada, Quebec, West-resource people, Indigenous Nations and New Canada of immigrants. And give each right to own internal law: Quebec - own language and court, Alberta - 50% rent from resources, Indians - real veto on projects on their land. Give uluses autonomy - they will stay. Squeeze - they will run.

Step 3. Conclude two different deals with two neighbors. With USA - harsh transactional deal in Trump logic: we hold for you Arctic and NORAD, you give us market without tariffs and do not claim Northwest Passage. With Europe - normative deal: we sell you not just raw material, but raw material with community certificate - clean uranium, clean lumber harvested by community. Then Europe pays us premium, not dictates laws.

Step 4. Prepare for death of Crown. British monarchy hangs by snot. When it collapses, there will be vacuum in Ottawa. Cannot wait. Must in 10 years prepare transition from Corporation Canada, where all are citizens of corporation, to Republic of Communities - republic of communities, where people is union of communities holding its land.

Then when light goes off in London, it will not go off in Canada. Because each valley, each island, each reserve will have its own light.

Final in one phrase: World cracks because three rules of property collided. Canada cracks because it is built by Khan's rule, but wants to live by Roman rule, having neither army of Rome nor network of Khan. It can be saved only by one thing - stop being corporation distributing yarliks and become union of homesteads where each homestead again becomes master of its land.
